In consideration of the engagement of the above-named Minor as a model, and for other good and valuable consideration as described, the receipt and sufficiency of which is hereby acknowledged, the undersigned Guardian hereby grants to the Photographer, his/her legal representatives, assigns, licensees, those for whom the Photographer is acting, and those acting with his/her authority and permission (collectively, “Photographer”), the absolute and irrevocable right and permission to take, use, reuse, publish, and republish photographic portraits or pictures of the Minor, or in which the Minor may be included, in whole or in part, or composite or distorted in character or form, without restriction as to alterations, in conjunction with the Minor’s own name, a fictitious name, or without any name, in any and all media now or hereafter known, for art, advertising, promotion, trade, editorial, educational, or any other lawful purpose whatsoever.

The undersigned Guardian further consents to the use of any accompanying text, graphics, video, or other editorial content that may be used or published in connection with the images.

The Guardian, on behalf of themselves and the Minor, hereby releases, discharges, and agrees to hold harmless and defend the Photographer, his/her legal representatives, assigns, and all persons acting under his/her authority or for whom he/she is acting, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking or processing of said images, or any subsequent publication or use thereof, including without limitation any claims for libel, defamation, or violation of any right of publicity or privacy.

The Guardian represents and warrants that they are of full legal age and have full authority to execute this release on behalf of the Minor, and that they have read and fully understand the contents of this release prior to signing it.

This Trade-for-Prints Model Release Agreement (“Agreement”) is entered into as of by and between the Model and the Photographer.

Purpose
This Agreement sets forth the terms under which the Model agrees to participate in a photo session with the Photographer in exchange for a limited license to use the resulting images, in lieu of monetary compensation. This arrangement is commonly referred to as a “Trade-for-Prints” or “TFP” agreement.

Scope of Work
The Photographer agrees to photograph the Model on at . The style, concept, and number of final edited images will be mutually agreed upon prior to the shoot.

Compensation
In lieu of financial compensation, the Photographer agrees to provide the Model with professionally edited digital images within days following the photo shoot. The Photographer will deliver these images via (e.g., online gallery, Dropbox, email).

Rights Granted to Photographer
The Model grants the Photographer and their legal representatives, licensees, and assigns the irrevocable and unrestricted right to use and publish the photographs in which the Model may be included for editorial, trade, portfolio, website, promotional, social media, and artistic purposes.

Model Usage Rights
The Photographer grants the Model a non-exclusive, non-commercial license to use the final delivered images for personal use, self-promotion, portfolio display, and social media.

Release of Liability
The Model hereby releases the Photographer, their agents, and assigns from all claims, demands, and liabilities arising out of or in connection with the use of the images, including any claims for defamation or invasion of privacy.

Age of Model
The Model affirms that they are over the age of 18. If the Model is under 18, a parent or legal guardian must sign below granting permission for the Model’s participation and release of image rights.

Model, for good and valuable consideration, the receipt of which is acknowledged, hereby grants to the Photographer, its legal representatives, assignees, and those acting under its authority, the unrestricted right and permission to copyright and/or use, and/or publish photographic portraits or pictures of the Model (the “Pictures”), and the negatives, transparencies, prints, or digital information pertaining to them, in still, single, multiple, moving or video format, or in which Model may be included in whole or in part, or composite, or distorted in form, or reproductions thereof, in color or otherwise, in any media for advertising or any other lawful purpose, subject to the privacy preferences selected above.

Model hereby relinquishes any right that they may have to examine or approve the finished product or products or the advertising copy or printed matter that may be used in connection with an image that Photographer has taken of the Model.

Model further releases Photographer, its parent company, subsidiaries, affiliates, officers, agents, servants, or employees (“Releasees”) from any claims for remuneration associated with any form of damage, foreseen or unforeseen, associated with the proper commercial or artistic use of these images unless it can be shown that said reproduction was maliciously caused, produced and published for the sole purpose of subjecting the Model to conspicuous ridicule, scandal, reproach, scorn and indignity. Model also waives any and all claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by Model, or any of the property belonging to Model, whether caused by the negligence of the Releasees, or otherwise, while performing the photography session, or while in, on or upon the premises where the photography session was performed.
